The Model Tenancy Act 2021
The Government of India introduced the Model Tenancy Act (MTA) in 2021 to modernise and balance tenant-landlord relationships. States are in the process of adopting it. Key provisions:
Tenant Rights
- Security deposit capped at 2 months rent for residential (urban) and 6 months for commercial
- Landlord cannot disconnect utilities to force eviction
- Landlord must give 24-hour notice before entering the property
- Rent can only increase as per the rent agreement — no arbitrary hikes mid-tenancy
- Right to receive a rent receipt for every payment
- Security deposit must be returned within 1 month of vacating
Landlord Rights
- Right to evict for non-payment of rent (with 15 days notice after 2 months default)
- Right to increase rent with 3 months notice after lease period ends
- Right to inspect the property with prior notice
- Right to claim damages for property damage beyond normal wear and tear
